Kandeel v. Advocate Health & Hospitals Corp.
January 23 – Bobber, Teich and Pippin is pleased to announce that the Illinois Appellate Court has upheld a jury verdict achieved by partner Michael Teich in excess of $2 million in the case of Kandeel v. Advocate Health & Hospitals Corp. The case, which was tried in the Cook County Circuit Court, involved claims of medical malpractice resulting in substantial injury to our client.
The defendant doctor challenged the jury's verdict, arguing that there were errors in jury instructions and demanding a new trial. However, the Illinois Appellate Court firmly rejected these arguments. In their opinion, the court stated that there was "no reversible error on any individual issue and no cumulative error," affirming the lower court's decision.
Justice Rochford authored the court's opinion, with Justices Lyle and Ocasio concurring in the judgment. This ruling solidifies the jury’s original findings and underscores the strength of the evidence presented during the trial.
Michael Teich, the BTP partner who tried the case, expressed satisfaction with the court's decision, highlighting its importance in affirming the integrity of the judicial process. "The trial judge and the jury made the right decisions throughout the trial, and this ruling by the Appellate Court confirmed that," said Teich. "We are gratified the Appellate Court recognized that our client prevailed in a fair trial and that justice has been upheld."
